Please read these Terms and Conditions carefully before using our site or engaging our services.

These Terms and Conditions (the “Terms”) govern access to and use of the website coastalexpresstransport.com (the “Site”) and the cargo transport, logistics, delivery, urgent-delivery, and truck-sales services (collectively, the “Services”) offered by Coastal Express Transport LLC (the “Company,” “we,” “us,” or “our”). By accessing the Site, requesting a quote, or using the Services, you (the “Customer” or “you”) agree to be bound by these Terms. If you do not agree, do not use the Site or the Services.

1. Acceptance

Using the Site or the Services constitutes your acceptance of these Terms and of our Privacy Policy. If you engage us on behalf of a company, you represent that you have authority to bind it.

2. Services and Quotes

Service descriptions are general and availability and scope may vary. Quotes and estimates are for informational purposes only, are non-binding, and are subject to change until confirmed in writing. Rates may change due to fuel, tolls, weight, distance, accessorial charges, or other factors.

3. Estimates and Delivery Times

Any transit or delivery times are estimates only and are not guaranteed. To the fullest extent permitted by law, we are not liable for delays caused by weather, traffic, mechanical issues, road or port conditions, customs, third parties, force majeure, or circumstances beyond our reasonable control.

4. Customer Responsibilities

The Customer agrees to: provide accurate and complete information; properly pack, label, and secure the goods; ensure the legality of the cargo; obtain any insurance it deems appropriate; and comply with applicable law. The Customer represents that it has the right to ship the goods tendered.

5. Cargo Liability and Claims

To the fullest extent permitted by applicable law — including, where applicable, the Carmack Amendment (49 U.S.C. § 14706) for interstate transportation — our liability for loss of or damage to cargo is limited to the minimum required by such law and/or to the released value declared on the bill of lading or transportation contract. We are not liable for indirect, incidental, special, or consequential damages or lost profits, nor for loss arising from inherent vice of the goods, improper packing, acts of God, or force majeure. All claims must be submitted in writing within the time required by applicable law and by the applicable bill of lading or contract; failure to do so waives the claim.

6. Trucks for Sale

Vehicles are sold “AS IS, WHERE IS,” with all faults and without warranty of any kind, express or implied, including any warranty of merchantability or fitness for a particular purpose. The buyer is solely responsible for inspecting the vehicle and performing due diligence before purchase, as well as for registration, DOT inspections, and financing. Any financing or inspection assistance we facilitate is not a guarantee of approval or of condition. To the fullest extent permitted by law, we disclaim all liability for the vehicle’s condition after the sale.

7. Payment

Payment is due on the terms agreed in writing. Past-due amounts may accrue interest and collection costs to the extent permitted by law. Services may be suspended for non-payment.

8. Site Use and Intellectual Property

The Site’s content is owned by or licensed to the Company and is protected by law. You may not copy, reproduce, or exploit the content without authorization. Any unlawful, fraudulent, or security-compromising use of the Site is prohibited.

9. Third-Party Links and Services

The Site may contain links to, or integrate, third-party services. We do not control and are not responsible for their content, policies, or practices.

10. Disclaimer of Warranties

The Site and the Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law, the Company and its owners, members, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, revenue, data, or goodwill, arising out of or related to the Site or the Services, even if advised of the possibility. In all cases, the Company’s total aggregate liability shall not exceed the amount actually paid by you for the specific Service giving rise to the claim (or US$100 if no payment was made). Some jurisdictions do not allow certain limitations; in that case, liability is limited to the greatest extent permitted.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its owners, members, employees, and agents from and against any claim, damage, loss, liability, cost, or expense (including reasonable attorneys’ fees) arising from your use of the Site or Services, your breach of these Terms, your violation of any law, or your goods or cargo.

13. Force Majeure

We are not liable for any failure or delay due to causes beyond our reasonable control, including natural events, weather, casualties, strikes, mechanical failure, utility outages, acts of authority, conflict, or emergencies.

14. Governing Law; Venue; Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Any dispute shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to that jurisdiction and venue. To the extent permitted by law, you waive participation in class actions.

15. General

If any provision is held invalid, the remaining provisions remain in effect. These Terms, together with any signed service contract, constitute the entire agreement. Failure to enforce any right is not a waiver. You may not assign these Terms without our consent.

16. Changes to These Terms

We may modify these Terms at any time. The current version will be posted on this page, and your continued use of the Site or Services constitutes acceptance.
